In today’s mobile society, the question of where to file child support and custody issues frequently arises. Gone are the days of families living in one house throughout the entire lives of their children. Job opportunities take us around the county, sometimes around the world.
When child support and custody issues arise within families who may have moved out of the state of their original determination, jurisdiction can become a tricky issue. Two laws have been enacted in all fifty states to solve the issue of where to file. These laws are the Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA) and Uniform Interstate Family Support Act (UIFSA). The UCCJEA ensures that courts in all 50 states will use the same criteria for deciding which state has authority to make and/or enforce custody issues. UIFSA was enacted so that all states will enforce the other state’s support orders in the same manner.
