As we enter Spring, many high school seniors are anxiously anticipating graduation. Many parents paying child support may also be anticipating a decrease in the amount of their child support payments. As their children graduate, they may also be aging out of child support. Generally in Florida, a child support obligation continues until the child reaches the age of 18. If the child is still in high school at that time, then support will continue until the child reaches the age of 19 or graduates from high school, whichever comes first.
If you are paying support for more than one child and your Order or Agreement does not specify the amount to be paid for the remaining child(ren) once the oldest reaches the age of emancipation, your support amount may not automatically reduce. If you unilaterally lower the support amount, you may be held in contempt. You are not protected from the issue of contempt even if you and your child’s other parent have reached a verbal agreement regarding a change in the amount.
