When a client believes that he and his spouse can agree on all the terms involved in their divorce, it may be possible to expedite the divorce process. Attorney Luther will prepare a proposed Marital Settlement Agreement to be presented to the client’s spouse. If both parties find the terms of the Agreement favorable, the Agreement can be signed, notarized and entered in the Court file.
It may be possible to reach an agreement before filing for divorce. If this is the case, Mr. Luther will file a Petition for Dissolution of Marriage along with the executed Marital Settlement Agreement on behalf of the client. The client’s spouse will enter an Answer and Waiver. By doing so, the spouse is admitting to all of the allegations and agreeing to all of the terms of the Petition. They are also waiving their right to be given notice of the final hearing.
Both parties will still need to file a completed Financial Affidavit and, if there are children involved, a Parenting Course Certificate of Completion.
