If a Divorce or Paternity action is filed in Florida, each party named in the action will be subject to mandatory disclosure. This is part of what is called the Discovery Process. Under the Florida Family Law Rules of Procedure, certain financial information must be provided by the parties. It enables each side to have a clear picture of the financial circumstances of the other side.
You will be required to complete a Financial Affidavit which is a detailed accounting of your income, expenses, assets and liabilities. You will also be asked to produce supporting documents such as pay stubs, banking and investment statements, tax returns, and property documents. If you have ownership in a business, you will be asked to provide documents related to the business.
The Discovery Process is an important time during any Dissolution of Marriage or Paternity action. A knowledge of the opposing party’s finances will allow your Family Law Attorney to negotiate a favorable settlement or represent your position to a judge at trial.
