A divorce is a legal suit against your spouse.  As such the Court requires proof that the Petition for Dissolution of Marriage and any other initial divorce pleadings have been received by your spouse.  Once the Petition is filed with the court, the court clerk will issue a summons to be served on your spouse along with any other initial pleadings.  Your family practice attorney will have the Petition personally given to your spouse by a sheriff or a process server.
